Website content is not a contract, offer, proposal, scope of work, or acceptance of any project, and it does not create a service relationship between you and the Company.

Website language and marketing materials do not expand, modify, or supplement the agreed scope of any project. Actual services are controlled exclusively by the signed agreement, Project Order, Scope of Work, amendment, or change order executed between Cox Aerial Solutions LLC and the customer (collectively, “Executed Agreements”). Executed Agreements — including their pricing, deliverables, deposits, cancellation terms, insurance, indemnification, and liability provisions — control the parties’ rights and obligations. If any inconsistency exists between this Website and an Executed Agreement, the Executed Agreement controls.

2. Quote Requests Do Not Authorize Work

Submitting a quote request, contact-form submission, email inquiry, phone inquiry, or requesting a preliminary pricing estimate through this Website does not authorize any work, does not book or reserve dates, and does not create a contract or service relationship.

A project is authorized only through the method permitted by the governing agreement. This may include a mutually signed Project Order or, under an active 365-day agreement, an accepted quote or proposal, authorized email approval, or authenticated Customer Portal acceptance from an Authorized Ordering Contact. Cox Aerial must acknowledge the project, and any required initial payment must be received before the project becomes active.

3. Acceptance of These Terms

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, do not use the Website.

4. Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for lawful personal or business informational purposes in accordance with these Terms.

5. Restrictions

You agree not to:

  • Copy, reproduce, or redistribute Website content without permission.
  • Reverse engineer or attempt to gain unauthorized access to our systems.
  • Upload viruses, malware, or malicious code.

You represent that you have the right to share the Submissions with us and that doing so does not violate any third-party rights or confidentiality obligations.

You retain all ownership of your Submissions. You grant Cox Aerial Solutions LLC a limited, non-exclusive license to receive, review, store, and use your Submissions solely for the purpose of evaluating and responding to your requested quote or providing the requested service. This license does not authorize Cox Aerial Solutions LLC to publish, publicly display, market, sell, sublicense, or otherwise share confidential maps, project files, customer imagery, infrastructure information, or other customer materials with third parties. Any broader use of customer maps, imagery, deliverables, confidential project files, or other work product is governed exclusively by the applicable Executed Agreement.

Do not submit sensitive, privileged, or confidential information through public web forms. For confidential materials, request delivery instructions and use the channels specified in your Executed Agreement.

7. Intellectual Property

All content on the Website — text, graphics, logos, images, software, trademarks, sample reports, and other materials — is owned by or licensed to the Company and is protected by applicable intellectual property laws. Nothing on the Website transfers any ownership rights to you.

8. No Warranty; Website Provided “As Is”

The Website is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation, or that Website content is complete, current, or free of typographical errors. Service capabilities, pricing, availability, and response times shown on the Website are informational goals and are not warranties.

9. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website. Liability for actual services is addressed exclusively in the applicable Executed Agreement.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Website shall be brought exclusively in the state or federal courts located in Kansas, and the parties consent to the jurisdiction and venue of those courts. Disputes arising under an Executed Agreement are governed by the venue and dispute-resolution provisions of that agreement.

We may update these Terms from time to time. Continued use of the Website after changes become effective constitutes acceptance of the updated Terms.
